The Iowa Supreme Court recently upheld a Polk County district court guilty verdict of Artell Young, a Des Moines man convicted of possession of crack cocaine, cocaine, and marijuana. The district court had sentenced Young to six years in prison for the offenses. The unique aspect of this case was that oral arguments were held before the justices at the Marshalltown Performing Arts Center, instead of the Iowa Judicial Branch building in Des Moines. Young’s attorney argued that the search of his residence, where contraband was found, was conducted without a search warrant, violating his rights. The state argued that federal probation agents had the right to search Young’s residence based on his probation agreement. The case became complex when federal officials declined to charge Young, but state officials proceeded with prosecution based on evidence from the search. The hearing was attended by members of the public, Marshall County Bar Association, Marshalltown High School staff, and students, receiving positive feedback from attendees. The next session of the Iowa Supreme Court holding oral hearings on the road will be in Lamoni in the spring.
