Iowa Attorney General Brenna Bird and Secretary of State Paul Pate have filed a lawsuit against the Biden administration for allegedly refusing to provide access to citizenship status information for over 2,000 registered voters whose status was questioned before the 2024 election. The lawsuit claims that the U.S. Citizenship and Immigration Services (USCIS) did not provide the list of noncitizens illegally registered to vote in Iowa, forcing the state to rely on imperfect data to prevent illegal votes. Along with USCIS, the lawsuit also names the U.S. Department of Homeland Security (DHS) and DHS Secretary Alejandro Mayorkas as defendants.
State election officials had checked voter rolls against a list of people who identified themselves as noncitizens with the Department of Transportation, but many of the individuals had subsequently registered to vote or voted. The refusal to provide information led to challenges by county elections officials and lawsuits from pro-voting groups. Despite some individuals proving their citizenship status, many ballots were ultimately rejected. The lawsuit seeks access to accurate citizenship status information to ensure the integrity of future elections.
